Your purchase is conducted with Eminent Cycles LLC, 1665 South Rancho Santa Fe Road, San Marcos, CA 92078. The purchase is carried out in USD and will include your local taxes and cost of shipping upon checking out. The purchase is managed using Shopify’s secure and reliable payment method that accepts most major credit cards and is encrypted to a level 1PCI compliancy using a 256 bit SSL certificates.

By purchasing through the eminentcycles.com online store, you the purchaser are accepting these terms and conditions and are consenting that you have legal capacity to do so. You have the option to print and save these conditions for later reference at your own convenience.

Receipt & Notifications

The Receipt and status notifications will be delivered throughout the order process to ensure you have all the latest information about the your purchase

Build & Delivery Timing

Eminent Cycles does its best to complete your bike build within 2 weeks plus shipping time, but if a delay should occur, we will notify you and discuss available options.

Shipment & Delivery

Your bike shipment is charged at a flat rate. It is shipped with the requirement that a signature be provided upon delivery unless otherwise requested. If no signature is requested, you the customer are responsible for accepting and receiving the delivery.

Right of Withdrawal:

If the purchaser decides to cancel the order prior to shipment, the purchaser may receive a full refund upon request.

Inspection Responsibility:

Upon receiving the bicycle, please review the bike for any damage or any errors in the build configuration and notify Eminent Cycles of any discrepancies within 30 days of the shipping date.

Return Policy:

Bike & Frame

If you are unhappy with your purchase at the time the bike is delivered or after riding it, you can return the bike within 30 days of the delivery date.   Upon receipt of bike by Eminent, you will qualify to receive a refund minus shipping charges (excludes damaged bikes).

  • Note 1: Before returning the purchase, contact Eminent Cycles for a Return authorization number (RA #).
  • Note 2: Returns are excluded on custom builds. 

Other:

If you are unhappy with your purchase at the time the product is delivered, you may return it within 30 days of the delivery date (assumes unused and in new condition).   Upon receipt of product by Eminent, you will qualify to receive a refund.

Warranty:

Eminent Cycles warrants its frame and specific frame parts to be free from manufacturing defects in materials and workmanship for a period of (3) years to the original purchaser from the date of purchase. This warranty does not extend to or include components or parts subject to wear and tear or damage to paintwork/oxidization. Examples of such parts include but not limited to: bearings, seals, cables, guides, all drive components, suspension components, wheels, tires, grips, all lubricants, brakes, brake fluid, etc. This warranty does not extend past the frame. For component warranty periods, please reference the specific component OEM manual for information. Should a bicycle frame be determined to be under warranty, Eminent Cycles will act in its own expense to remedy any defects that occur during the period of warranty. In the case of non-availability, we reserve the right to provide replacements in a different color/design or equivalent model from a later year. Other claims made on the basis of the warranty shall be excluded, such as compensation for; transport, assembly/disassembly, etc. Labor charges for other requests, such as unwarranted service or parts replacement during warranty work is not covered. The following conditions apply with respect to the warranty: The warranty shall not apply in circumstances where the bicycle exhibits damage or appearances of wear and tear caused by use which is improper, inappropriate, or unauthorized in accordance with the below categories:

  • Neglect of the product (insufficient care and maintenance).
  • Alterations to the frame or fork (e.g. engravings or painting).
  • Installation and conversions using additional components not expressly authorized by Eminent Cycles.
  • Ongoing operation of a bicycle with wrongly adjusted, defective or worn out bearings, or defective suspension elements
  • Damage to the seat tube due to improper insertion depths (see chart in seat post adjustment).
  • Unintended use such as competitive events, severe off road riding, riding on severe terrain, riding in severe climates, riding with heavy loads above 250lbs for extra-small, small & medium frames & 300lbs for large & extra-large frames, commercial activities, and other types of non-standard use.

To enable the above full warranty, please go to www.eminentcycles.com/support/bike registration and register your new bike purchase within 90 days.  If you don't register your bike within 90 days of purchase, the warranty will default to a limited 1 year warranty.   

The above is the current warranty and the warranty for prior or future Eminent’s bicycles may vary. Please consult your models manual for its specific warranty.

Crash Replacement

If you were to have an accident or crash that has damaged your frame, Eminent Cycles offers the ability to replace your frame or damaged part at a reduced price for up to three years after the purchase date by the original owner. Please contact service@eminentcycles.com for pricing and next steps. Note: Components are excluded in this offer (ex: shocks, headsets, bottom brackets, etc…). We reserve the right to suspend this service on a case-by-case basis if we determine that damage was caused willfully.

Liability:

Eminent Cycles LLC is not responsible for any damages to you, others, or any property resulting from riding, transporting, or any other use of this bicycle. If your frame breaks, malfunctions, or fails in anyway, Eminent Cycles LLC shall hold no liability or duties outside the repair or replacement of the frame pursuant in the terms described in the warranty. In Purchasing or acquiring this bicycle, you agree to all terms and conditions outlined here.

Governance and Enforceability

This purchase agreement and any dispute or claim against Eminent Cycles LLC out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of the United States of America. The parties irrevocably agree that the courts of San Diego, California, USA shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).

If any provision of this Agreement is found by a proper authority to be unenforceable or invalid, such unenforceability or invalidity shall not render this Agreement unenforceable or invalid as a whole and, in such event, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions. This Agreement sets forth the complete and exclusive statement of agreement between the purchaser and Eminent Cycles LLC with regard to the subject matter hereof.

Usage Disclaimer

Mountain biking is inherently a dangerous activity, and it is the rider’s responsibility to manage and assume the risks associated with such activity. Eminent Cycles LLC is not responsible for any damages (personal or property) arising out of use from riding, transporting or other uses of the bicycle.

Disclaimer of Bicycle Life

Every bicycle and its component parts have a finite, limited useful life. The length of that life will vary with the construction, materials, maintenance, and care the frame and components. The type and amount of use to which the frame and components are subjected may also reduce their useful life. Use in competitive events, severe off road riding, riding on severe terrain, riding in severe climates, riding with heavy loads above 250lbs for extra-small, small & medium frames & 300lbs for large & extra-large frames, commercial activities and other types of non-standard use can dramatically shorten the life of the frame and components. Any one or a combination of these conditions may result in an unpredictable failure. It is with this understanding that we recommend to you (the user of the bike) to follow the maintenance chart for inspection/service to ensure safe operation of your bicycle and prevent injury.

Warning: When the useful life of your bike or its components is near over, continued use will be hazardous. Refer the components OEM Manual for their life span, recommended maintenance, and replacement.

Warning: In the event of a crash, it is required that you inspect your bicycle prior to riding again for any deviations from the original condition (example: carbon impacts, fractures or bent parts). This may result in unsafe riding conditions or loss of control resulting in personal injury. If you are not sure how to properly inspect your bicycle, we recommend contacting Eminent Cycles for service.
